By accessing or using the Site, you agree to these Website Terms of Use (“TOU”). If you do not agree, do not use the Site.

1. Who may use the Site

1.1 The Site is intended for users 18 years or older (or age of majority) located where use is lawful. We do not knowingly target children under 13.

1.2 If you use the Site on behalf of a company, you represent you have authority to bind that company.

2. Informational nature; no professional advice

2.1 Site content—including tier descriptions (Sprint, GT, Overtake, Redline), compatibility notes, blog posts, and “Driven by Performance” marketing—is for general information only.

2.2 Configurator outputs and price displays may be approximate until we confirm an order. Component availability and pricing can change.

2.3 Nothing on the Site is legal, tax, or investment advice.

3. Accounts and forms

3.1 If the Site offers accounts, quote requests, or support forms, you agree to provide accurate information and keep credentials confidential.

3.2 We may refuse, suspend, or terminate access for suspected fraud, abuse, or TOU violations, to the extent permitted by law.

4. Orders and purchases

Purchases are governed by the Customer Terms of Sale and, for custom builds, the Build / Service Agreement. Site TOU do not override those commercial terms. In a conflict about a purchase, the Terms of Sale / Build Agreement control.

You agree not to:

  1. use the Site for unlawful purposes;

  2. attempt unauthorized access to systems, Wix infrastructure, or other users’ data;

  3. probe, scan, or load-test the Site without our prior written consent;

  4. scrape, harvest, or use bots to copy prices, images, or content for commercial reuse, except ordinary search-engine indexing;

6.1 The Site, including text, graphics, logos, icons, images, videos, design, and compilation, is owned by Paddock or its licensors and protected by U.S. and international IP laws. “Paddock PCs,” “Driven by Performance,” and tier names are branding elements of Paddock.

6.2 We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal or internal business shopping and support—not to copy or commercially exploit Site content.

6.3 Product names and logos of component manufacturers (NVIDIA, AMD, Intel, Microsoft, etc.) are property of their owners and used for identification.

6.4 You may not use our trademarks in domain names, ads, or social handles in a confusing way without written permission.

9. Privacy

Our Privacy Policy describes how we collect and use personal information. By using the Site, you acknowledge that policy.

10. Disclaimers (Site use)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES REGARDING THE SITE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. Non-waivable rights remain.

11. Limitation of liability (Site use)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PADDOCK AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM SITE USE, OR FOR ANY AMOUNT EXCEEDING US $100 IN THE AGGREGATE FOR PURE SITE-USE CLAIMS (AS OPPOSED TO PRODUCT PURCHASE CLAIMS, WHICH ARE GOVERNED BY THE TERMS OF SALE LIABILITY CAP). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS. Product-related liability is governed by the Terms of Sale and Warranty Policy.

12. Indemnity

To the extent permitted by law, you will indemnify and hold harmless Paddock from third-party claims arising from your User Content, misuse of the Site, or violation of these TOU, except to the extent caused by our willful misconduct. Consumer indemnities are limited where prohibited.

13. DMCA / IP complaints

We may remove content and terminate repeat infringers as appropriate.

14. Modifications to the Site and TOU

We may change or discontinue Site features at any time. We may update these TOU by posting a revised version with a new Effective Date. Continued use after posting constitutes acceptance of changes, except where law requires additional consent. Material changes may also be highlighted by notice banner or email where appropriate.

15. Governing law; disputes

These TOU are governed by the laws of the State of Arizona, excluding conflict-of-law rules. Disputes arising from Site use shall be resolved as stated in the Customer Terms of Sale dispute section (state or federal courts in Maricopa County, Arizona, with small-claims court available to either party), after 30 days’ informal resolution to josh@paddockpcs.com.

16. Miscellaneous

Severability, no waiver, assignment, entire agreement as to Site use (subject to purchase documents for orders), and survival apply as in the Terms of Sale. If any TOU provision conflicts with mandatory law, the law controls.
